I think yugioh is kind of .... because remember when he was dueling against rafael and he lost his soul? couldn't he not play orichaclos card and lose to rafael instead of doing what he did in the show? if I was atem, I would just resign against rafael instead of playing orichaclos and putting my life in stake.
same thing with yugioh vs yugi in the arc. Atem could have just resign on purpose and therefore he would move on to the spirit world since atem has to lose to go to the spirit world.
